Acceptable Use Policy

The short version

Use Fondfully to plan thoughtful gifts for the people in your life. Don't use it to hurt anyone, break the law, or break Fondfully.

1. Who this applies to

This policy is part of our Terms of Service. It applies to everyone who uses Fondfully, including people who open or claim from a gift brief someone shared with them.

2. Gift briefs and claims

Gift briefs are for sharing gift ideas with people you trust. Don't use a brief, or a claim on one, to share or send:

• anything unlawful, or that encourages unlawful activity;
• sexual content involving minors, or anything that exploits or endangers children. We report it to the National Center for Missing & Exploited Children and to the authorities;
• threats, harassment, bullying or hateful content, or anything meant to intimidate or shame someone;
• personal information about someone that you have no right to share, or that's meant to expose, stalk or endanger them;
• content that infringes someone else's copyright, trademark, privacy or other rights;
• malware, phishing, or links to either;
• spam, advertising, or content that has nothing to do with gifts, such as using briefs to host or distribute files; or
• anything that impersonates someone else or misleads people about who you are.

Don't try to guess, collect or brute-force brief links, or claim ideas on a brief that wasn't shared with you.

3. Support and communications

• Treat our team with respect. We don't accept harassment, threats or abuse.
• Don't send spam, false reports or malicious attachments.
• Share only the information we need to help you, and avoid sending other people's sensitive information.

4. Using the Service

Don't:

• overload, disrupt or interfere with the Service, our servers or networks, or other people's use of them;
• get around security measures, rate limits, plan limits or purchase verification, or make fraudulent purchases, refund claims or code redemptions;
• scrape, crawl or access the Service by automated means, other than through our apps and website as intended;
• create accounts automatically or in bulk, create accounts to get around a suspension or plan limit, or share or sell accounts or codes;
• access or try to access anyone else's account or data;
• decompile, disassemble or reverse engineer the apps, except to the extent the law expressly allows it, or as our security policy allows;
• probe, scan or test the security of the Service except in line with our Security and Vulnerability Disclosure policy. Testing our admin console is never allowed without our written permission;
• use Fondfully to compile information about people for anything other than your own personal gift planning, such as marketing lists or decisions about someone's credit, employment, insurance or housing;
• use Fondfully in breach of privacy, consumer protection, export control or sanctions laws; or
• use the Fondfully name or logo in a way that suggests we endorse you, or that could confuse people.

5. Reporting a problem

If you see a gift brief or anything else that breaks this policy, email support@fondfully.com with the link and what you've seen. Because briefs are encrypted with a key in the link, we can only see a brief's content if you send us the whole link, so include it if you're comfortable doing so. To report a security issue, write to security@fondfully.com.

6. Copyright complaints

If you believe a gift brief or other material on Fondfully infringes your copyright, send a notice to our copyright agent: Epicalin, LLC, Attn: Copyright Agent, 1810 N Burning Bush Ln, Mount Prospect, Illinois 60056, United States; phone +1 (312) 401-4626; email support@fondfully.com with the subject "Copyright notice". To be valid under the US Digital Millennium Copyright Act, the notice must include:

1. your physical or electronic signature, as the copyright owner or someone authorized to act for them;
2. the copyrighted work you believe is infringed;
3. the material you believe infringes it, with enough detail for us to find it, such as the whole brief link;
4. your name, address, phone number and email address;
5. a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law; and
6. a statement that the information in your notice is accurate and, under penalty of perjury, that you're authorized to act for the copyright owner.

If we disable a brief because of a notice and you believe that was a mistake, you can send a counter-notice to the same address, and we'll explain what it needs to include. We close, in appropriate circumstances, the accounts of people who repeatedly infringe others' copyrights.

7. What we do

If we believe this policy has been broken, we may, depending on how serious it is:

• warn you;
• disable a gift brief link;
• limit features, or suspend or close the account involved;
• cancel codes, or Plus obtained through fraud; and
• report unlawful activity to the authorities, and cooperate with lawful requests.

We act in proportion to the problem and, where it's reasonable and lawful, tell you what we did and why. We can't see your vault, and we don't monitor what you keep in it. If you think we got it wrong, reply to our message or write to support@fondfully.com, and a person will review it.
